1. Acceptance of terms
By accessing or using Nife's websites, products, or services ("Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. The services
Nife provides a hybrid cloud and edge application platform, including but not limited to Nife Deploy, Nife Cost, Nife Kernel, Nife LB, Nife Edge, Nife Filehost, Nife LLM Labs, AI SRE, and the Nife Marketplace. Nife may add, modify, or discontinue features of the Services at any time.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.
4. Acceptable use
You agree not to use the Services to: violate any applicable law; infringe the intellectual property or privacy rights of others; deploy malware, or content intended to disrupt, damage, or gain unauthorized access to any system; or resell or sublicense the Services without our written consent.
5. Fees and payment
Paid plans are billed in advance on a recurring basis as described at checkout or in your order form. Fees are non-refundable except as required by law or as expressly stated in an agreement with Nife. Nife may change pricing with notice for future billing periods.
6. Customer data
You retain all rights to the data, applications, and content you deploy or store using the Services ("Customer Data"). You grant Nife a limited license to host, process, and transmit Customer Data solely to provide and support the Services.
7. Intellectual property
Nife retains all rights, title, and interest in the Services, including all software, branding, and documentation. These Terms do not grant you any rights to Nife's trademarks or logos without prior written permission.
8. Third-party services
The Services may integrate with or link to third-party services, infrastructure providers, or open-source software. Nife is not responsible for the availability, content, or practices of third-party services.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in a written agreement with Nife.
10. Limitation of liability
To the maximum extent permitted by law, Nife will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.
11. Termination
You may stop using the Services at any time. Nife may suspend or terminate access to the Services for breach of these Terms, non-payment, or as required by law, with notice where reasonably practicable.
12. Changes to these terms
Nife may update these Terms from time to time. Material changes will be communicated via the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles, unless otherwise agreed in a signed enterprise agreement.
